Terms of sale and use
These terms cover two things: looking at the site, and buying a print from it. By using fieldframes.cc or placing an order you agree to them. "We", "us" and "Field Frames" mean [LEGAL ENTITY NAME], [BUSINESS ADDRESS], Great Falls, Montana. "You" means the person browsing or buying.
Using the site
The gallery is free to look at. Some folders are shared only with friends and family and need a login; if you have one, keep it to yourself and do not lend it. Please do not scrape, bulk-download, mirror or frame the site, probe it for weaknesses, or use the photographs for anything, including training machine-learning systems. The photographs are copyrighted and our copyright page explains what that means.
How ordering works
Prices are shown in US dollars. Sales tax, where we are required to collect it, and shipping are added at checkout before you pay. Payment is taken by Stripe; we never see your card number.
When you complete checkout we send you an order confirmation by email. Our acceptance of your order, and the moment a contract forms, is when we send the order to production. Until then we may decline or cancel an order, for example because of an obvious pricing mistake, a problem verifying payment, or because we cannot ship to your address. If we cancel, you get a full refund.
Made to order
Every print is produced individually after you order it by a professional print partner, then shipped to you directly. Because production starts quickly, you can only cancel or change an order before it enters production. Details, including delivery times and what to do if something arrives damaged, are on our shipping and returns page, which forms part of these terms.
Prints are made from the photographer's master file on the paper or material described on the product page. Screens vary and paper is not a screen, so slight differences in colour, contrast and tone between what you see on your device and the finished print are normal and are not a defect. Sizes are nominal and may vary by a few millimetres.
What you get when you buy a print
You get the physical print. You do not get the copyright in the photograph or any right to reproduce it, scan it, sell copies of it, or use it commercially. You may display the print privately or in your business premises, and you may resell that one physical print as you would any object you own.
Accuracy of the site
We try to keep descriptions, prices and availability correct, but we are a small studio and mistakes happen. If we discover an error affecting an order you have placed we will tell you and give you the option to proceed at the correct price or cancel for a full refund.
Our responsibility to you
If a print is defective or not what you ordered, our obligation is to reprint it or refund it as described on the returns page. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it. Nothing here limits rights that consumer law gives you and that cannot be excluded, including your rights under Montana law and the consumer protection law of the place where you live.
The site is provided as it is. We do not promise it will be available at all times or free of errors.
Your account
If we have given you a login, you are responsible for what happens under it. We may close accounts that are misused. You can ask us to delete your account at any time by emailing us.
Disputes and governing law
If something goes wrong, email us first at [email protected]; almost everything can be fixed that way. These terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules, and any dispute that cannot be resolved informally will be heard by the state courts sitting in Cascade County, Montana (the Eighth Judicial District Court or the Cascade County Justice Court) or the United States District Court for the District of Montana, Great Falls Division, unless the law where you live gives you the right to bring it elsewhere.
Changes
We may update these terms from time to time. The date at the top tells you when they last changed. Orders are governed by the terms in force when you placed them.
Plain-language summary: buy a print, we make it and ship it; cancel before it goes to print; damaged or wrong means reprint or refund; the print is yours, the photograph stays the photographer's.
